General Terms and Conditions

1. Provider

These General Terms and Conditions apply to services and offers provided by:

Next Level Travel B.V. Kaya Loiseaux Maduro 13 Willemstad, Curaçao

Registered with the Curaçao Chamber of Commerce & Industry under registration number 167070.

2. Scope

These terms apply to bookings, inquiries and services provided by Next Level Travel B.V., in particular island tours, vacation planning, and the brokering of tourist services.

Additional terms may apply to individual products or services.

3. Own and Brokered Services

The CuraVida Island Tour and the Next Level Island Tour are Next Level Travel B.V.'s own offerings.

For rental cars, accommodations, activities and other services provided by external providers, Next Level Travel may act solely as an intermediary.

In such cases, the contract for the brokered service is generally formed directly between the customer and the respective external provider.

The respective provider is generally responsible for performing that service, and that provider's own business, payment, booking and cancellation terms may apply.

Next Level Travel may receive a commission from the respective provider for successful referrals. This generally does not increase the regular provider price communicated through Next Level Travel.

4. Formation of Contract

CuraVida Island Tour

The guest makes a booking through the booking system. Subject to availability, the booking becomes binding once confirmed by Next Level Travel.

Next Level Island Tour

The inquiry form does not initially constitute a binding booking. After the inquiry is received, preferences, scope, duration and price are coordinated personally. A binding booking is only formed once the agreed services have been confirmed and Next Level Travel has expressly confirmed the tour.

Inquiries regarding vacation planning, rental cars or activities do not automatically constitute a binding booking of the third-party services mentioned therein.

5. Prices and Payment

For the CuraVida Island Tour, the price stated at the time of booking applies.

The regular price is currently 100 US dollars per person, payable on site.

If US dollars are not available, 100 euros per person may exceptionally be accepted in cash. Under this payment option, US dollars and euros are treated 1:1.

The Next Level Island Tour is calculated individually. The specific total price is communicated to the guest before the binding booking is made.

Entrance fees, meals, external activities and other additional services are only included in the tour price if expressly stated or individually agreed.

Additional requests or significant extensions may be charged separately following prior agreement.

6. Scope of Services

The service description agreed at the time of booking or confirmation is decisive.

Photos, videos, descriptions and examples on the website convey the typical character of our offerings.

They do not constitute a guarantee that weather, natural conditions, wildlife, traffic, visitor numbers or other circumstances that cannot be fully controlled will exactly match the conditions shown or described on a particular day.

Personal dissatisfaction, a change in one's own preferences during the tour, a voluntary decision to skip individual program items, or a voluntary early termination of a tour generally does not give rise to a claim for full or partial reimbursement.

Mandatory statutory claims in the event of an actually defective service remain unaffected.

7. Changes to the Tour Itinerary

The route, order, stops, duration of stays and time schedule may be adjusted where necessary or sensible due to weather, traffic, safety, road closures, official measures, opening hours, local conditions or other organizational circumstances.

Next Level Travel may replace or omit individual program items with suitable alternatives.

Reasonable changes to the tour itinerary generally do not give rise to a claim for a price reduction or damages, unless mandatory statutory provisions provide otherwise.

8. Personal Responsibility

Guests are responsible for assessing for themselves whether their physical abilities and personal circumstances are suitable for the respective tour and any voluntary activities.

Swimming, snorkeling, being on beaches, rocks or in the water, and comparable voluntary activities are generally undertaken at the guest's own risk.

Safety instructions given by the guide or other responsible persons must be followed.

For damages or health impairments resulting from pre-existing health conditions, self-chosen risks, or disregard of safety instructions, Next Level Travel is liable only to the extent liability is mandatorily required by law.

9. Personal Belongings

Guests are generally responsible for their own personal belongings, valuables, electronic devices and other property.

Next Level Travel is liable for loss, theft or damage only to the extent liability is mandatorily required by law.

10. Delay and No-Show

The guest is responsible for arriving at the agreed meeting point on time.

Next Level Travel is not obliged to delay the start of the tour due to late guests.

In the event of late arrival, no-show, or voluntary termination, there is generally no claim to make up a missed tour or individual services, or to receive a refund.

Where organizationally possible, Next Level Travel may voluntarily attempt to offer a workable solution. There is no entitlement to this.

11. Cruise Guests

Changes to ship schedules, delayed arrival, a ship not calling at Curaçao, route changes, as well as decisions by cruise lines, port authorities or other competent bodies, are beyond Next Level Travel's control.

If a cruise ship cannot call at Curaçao, or if the guest is prevented from going ashore due to corresponding circumstances, no cancellation costs will arise for our own tours.

In the event of delayed arrival, we attempt to adjust the tour schedule as far as organizationally possible. However, an adjustment or full completion cannot be guaranteed.

12. Liability

Next Level Travel is liable within the scope of mandatory statutory provisions.

To the extent permitted by law, liability is excluded in particular for events beyond Next Level Travel's reasonable control, including weather events, natural conditions, traffic disruptions, road closures, official measures, changes to ship schedules, actions of independent third-party providers, or comparable extraordinary circumstances.

For activities undertaken at the guest's own responsibility, disregard of safety instructions, or damages or accidents caused by the guest themselves, Next Level Travel is liable only to the extent liability is mandatorily required by law.

Claims that cannot be excluded by law remain unaffected.

13. Services Provided by Third Parties

For brokered services, the respective external provider is generally responsible for the proper performance of its service.

Next Level Travel is not liable for acts or omissions of independent third-party providers, unless such liability is mandatorily required by law.

14. Force Majeure and Extraordinary Circumstances

If a service cannot be performed, or can only be performed in substantially altered form, due to extraordinary, unavoidable circumstances beyond Next Level Travel's control, Next Level Travel may change, postpone or cancel the service.

This may include, in particular, extreme weather conditions, safety risks, official orders, vehicle breakdown, a guide's short-notice unavailability, or comparable circumstances that cannot reasonably be avoided.

To the extent payments have already been made for a service cancelled by Next Level Travel itself and no replacement service is agreed, these will generally be refunded in full.

Further claims, in particular for reimbursement of flights, cruises, hotels, rental cars or other travel and consequential costs, exist only to the extent mandatorily required by law.

15. Complaints

If a problem arises during a service, the guest should inform Next Level Travel as directly as possible.

This gives Next Level Travel the opportunity to find a workable solution during the service itself.

16. Applicable Law

To the extent permitted by law, contracts with Next Level Travel B.V. are governed by the law of Curaçao.

Mandatory consumer protection provisions that apply due to the customer's place of residence or other mandatory statutory provisions remain unaffected.

17. Final Provisions

Should any individual provision of these terms be invalid or unenforceable, the remaining provisions generally remain unaffected.
